1. Introduction

Welcome to SecureSend. These Terms of Service ("Terms") govern your access to and use of our secure email service. By creating an account or using our service, you agree to these Terms.

Please read these Terms carefully. If you do not agree, you may not access or use our service.

2. Service description

SecureSend provides a secure email service that allows you to send encrypted messages with SMS verification. Our service includes:

• Encrypted messaging — send secure, encrypted messages to recipients.
• SMS verification — two-factor authentication for message recipients.
• Automatic expiration — messages are automatically deleted after a set period.

3. Account registration

To use our service, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security and confidentiality of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

4. Acceptable use

You agree to use our service only for lawful purposes. You may not use our service to:

• Send spam, unsolicited messages, or bulk commercial emails
• Transmit illegal, harmful, threatening, or offensive content
• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Attempt to gain unauthorized access to our systems or networks
• Impersonate any person or entity

5. Payment terms

Our service is offered on a subscription basis. By subscribing, you agree to:

• Pay the applicable subscription fees as described at the time of purchase
• Provide valid payment information
• Authorize recurring charges for your subscription period

We offer a 14-day free trial. After the trial, your subscription will begin at €29/month unless canceled. You may cancel any time through your account settings.

SecureSend reserves the right to modify pricing with reasonable notice to existing subscribers.

6. Intellectual property

The SecureSend service, including all content, features, and functionality, is owned by us and protected by copyright, trademark, and other intellectual-property laws. You may not copy, modify, distribute, or create derivative works based on our service without our express written permission.

You retain ownership of any content you send through our service. By using our service, you grant us a limited license to process and transmit your content solely for the purpose of providing the service.

7. Service availability

We strive to maintain high availability. However, we don't guarantee that our service will be available at all times. We may temporarily suspend access for maintenance, updates, or other operational reasons.

• Scheduled maintenance — we notify users in advance.
• Emergency maintenance — unplanned outages may occur; we restore service ASAP.
• Service suspension — SecureSend reserves the right to suspend or discontinue the service at any time.

8. Limitation of liability

To the maximum extent permitted by law, SecureSend shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our service.

Our total liability for any claims shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

9. Disclaimer of warranties

Our service is provided "as is" and "as available" without warranties of any kind. We do not warrant that our service will be uninterrupted, error-free, or completely secure.

While we implement industry-standard security measures, no method of electronic transmission or storage is 100% secure. You use our service at your own risk.

10. Termination

Either party may terminate this agreement at any time:

• You may cancel through your account settings.
• We may suspend or terminate your account if you violate these Terms.
• We may discontinue the service with reasonable notice.

Upon termination, your right to use the service will immediately cease. Any data associated with your account may be deleted in accordance with our Privacy Policy.

11. Governing law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from these Terms shall be resolved in the courts of Eindhoven, the Netherlands.

12. Changes to terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page and, where appropriate, by email. Your continued use of the service after such changes constitutes acceptance of the updated Terms.
